At the end of this post you will find two free power of attorney templates-one is a general power of attorney template and the other is a special power of attorney template.
A power of attorney is a legal document by which one person grants power to another person to act on behalf of the person granting the power. The person granting this power is called the Principal and the person to whom he is giving this power is called an Agent.

Generally a power of attorney can be granted without the need for a written document or instrument; however there are some occasions when the law demands a written power of attorney to recognise the agent as legitimately appointed by the principal to act on his behalf.

The general power of attorney template which you will find at the bottom of this article grants a general power to the agent to act in all matters on behalf of the principal. This may arise if the principal was outside the jurisdiction for some time and still wished someone, his agent, to act on his behalf when he is away.

It can also arise in times of illness or infirmity when the principal needs to appoint someone to act on their behalf.

A special power of attorney is a limited power insofar as it confers on the agent the power to act in relation to a specific matter, for example signing a contract.

Powers of attorney can be drafted in specific ways to cater for the needs of the principal and should make provision for the death of the principal or serious illness or incapacity. It can be drafted for a specific purpose or function and generally will terminate on the death of the principal.

Granting a power of attorney should not be done lightly; you should always obtain legal advice as to the consequences of granting a power of attorney.

The consequences of not doing so can cause serious problems later so treat your power of attorney and the powers you grant with it a great degree of caution.
